Times backs down off blog threat

The New York Times has backed off its threat to shut down TheNationalDebate.com unless it keeps its fake Times Columnist Correction page offline.

In response to a fax an attorney sent on behalf of The National Debate, The New York Times withdrew its DMCA take-down notice as long as the site makes it clear the corrections page is a parody ... herefore protected under the First Amendement.

The Times legal department wrote: "Thank you for responding to our complaint. By adding the bold-faced disclaimer at the top of the faux Columnist Corrections Page, you are no longer confusing readers and as a result of this change, we agree that the page is now a parody which is protected under the First Amendment. We are copying [ISP] Verio on this e-mail in order to inform them that we no longer have any objections to your site."

Sounds like a reasonable compromise, though as Robert points out on his site, it was actuallly the mirror sites that added the bold disclaimer. As of this posting, the corrections page on his site still has no such disclaimer.
